After the Office of the Special Prosecutor (OSP) issued an INTERPOL Red Notice and designated him a wanted fugitive, he applied for permission to alter his writ and get discovery.

 

Ken Ofori-Atta is listed as sought on the Red Notice list of INTERPOL.

On Tuesday, November 25, 2025, the OSP provided an update on the matter, stating that Ofori-Atta’s motion was dismissed by the court due to the “unnecessary” nature of the documents he wanted.

The Human Rights Court also declared Ofori-Atta’s claim to be a “waste of the court’s time” and ordered him to pay GH¢5,000.

“Kenneth Ofori-Atta filed multiple lawsuits contesting his designation as a wanted person and the arrest warrant that supported that designation. This morning, the Human Rights Court denied his request for leave to amend his writ and obtain discovery.

 

“The Court decided that the documents requested were unnecessary and assessed costs of GHS 5,000 against the applicant for wasting the Court’s time,” the OSP said.

“The substantive verdict on the motion to amend the original writ has been deferred to December 12, 2025,” he continued.

Ken Ofori-Atta was officially added to INTERPOL’s Red Notice database in June 2025 following his designation as a wanted fugitive by the Office of the Special Prosecutor (OSP).

According to the Red Notice, which was published on June 6, 2025, Ofori-Atta is a 65-year-old male Ghanaian who was born in Accra on November 7, 1959. He is 1.7 metres tall, has dark hair and eyes, and speaks English and Twi.

 

According to INTERPOL, his offence is “using public office for profit”. The OSP believes he is currently in the United States for medical treatment; thus, they are seeking international assistance to locate him and temporarily detain him while they await extradition or voluntary surrender.

The Office of the Special Prosecutor (OSP) is prosecuting the former minister and seven other people in the SML case on many corruption-related accusations.

These include the controversial National Cathedral project and a revenue assurance deal with Strategic Mobilisation Ghana Ltd (SML).
