“a proclamation that direct violations of Article 78(1) of the 1992 Constitution occur with any ministerial appointment that has not been approved by the Parliament beforehand.”
The order in question pertains to the President of the Republic of Ghana’s submission of the names of the Ministers of State and the Deputy Minister of State to Parliament for approval prior to their appointments being revoked or terminated on February 14, 2024. These individuals were allegedly reassigned to other ministerial and deputy ministerial offices for the purpose of being appointed as ministers of state and deputy ministers of state.
The Speaker of Parliament, who is the first defendant in this case, is ordered to halt the process of screening and endorsing the names of the President’s nominees to Parliament until the condition that a Minister of State must be appointed by the President with prior approval from Parliament is met. This pertains to the Ministers and Deputy Ministers of State whose appointments were revoked on February 14, 2024, and who have been reassigned to new Ministerial and Deputy Ministerial offices.
“a perpetual injunction order prohibiting the Speaker of Parliament, the first defendant in this case, from carrying out the screening and approval of the presidential nominees’ names submitted to Parliament until the condition that a minister of state must be appointed by the president with the consent of Parliament is met with regard to the ministers and deputy ministers of state whose appointments were revoked on February 14, 2024, and who have been reassigned to new ministerial and deputy ministerial offices.”
