NDC Makes Fatal Errors In Their Petition To The Supreme Court That’ll Cost Them Dearly – Photo Details Drop

Mistakes spotted in viral pictures believed to be the NDC’s petition to the Supreme Court as they challenge the NPP over the 2020 presidential election results which NDC have tagged as flawed and discredited get the internet talking.

After a long period of legal consultation, the opposition National Democratic Congress, NDC, eventually submitted their petition to the supreme court, seeking relief as the aggrieved party in the 2020 presidential elections.

In the NDC’s petition to the apex court in Ghana, it states five major basis for their decision to take legal actions against the NPP and the Electoral Commission’s chair, Mrs. Jean Mensa.

Flagbearer of the National Democratic Congress (NDC), John Dramani Mahama, has called on the Supreme Court to cause the Electoral Commission to conduct a second election.

Mahama wants the elections to be held between just him and the incumbent, Nana Akufo-Addo as candidates.

Mahama also wants an injunction to be put on Akufo-Addo to stop him from parading himself as President-elect.

In his petition to Supreme Court, Mahama stated the above and a few others as his relief in the petition filed before the apex court.

The election petition case was filed on Wednesday, December 30, 2020, by Mahama’s lawyers following the party‘s audit of the 2020 Presidential results and approval by the National Executive Committee and Council of Elders of the party.

Find below Mahama’s reliefs

(a) A declaration that Mrs. Jean Adukwei Mensa, Chairperson of [EC] and the Returning Officer for the Presidential Elections held on 7`. December 2020 was in breach of Article 63(3) of the 1992 Constitution in the declaration she made on 9th December 2020 in respect of the Presidential Election that was held on 7th December 1020;

(b) A declaration that, based on the data contained in the declaration made by Mrs. Jean Adukwei Mensa, Chairperson of [EC] and the Returning Officer for the Presidential Elections held on 7th December 2020, no candidate satisfied the requirement of Article 63(3) of the 1992 Constitution to be declared President-elect

(c) A declaration that the purported declaration made on 9th December 2020 of the results of the Presidential Election by Mrs. Jean Adukwel Mensa, Chairperson of Respondent and the Returning Officer for the Presidential Elections held on 7″ December 2020 is unconstitutional, null and void and of no effect whatsoever;

(d) An order annulling the Declaration of President-Elect Instrument, 2020 (C.1. 130) dated 9th December 2020, issued under the hand of Mrs. Jean Adukwel Mensa, Chairperson of the [EC] and the Returning Officer for the Presidential Elections held 7′ December 2020 and gazetted on 10th December 2020;

(e) An order of injunction restraining [President Akufo-Addo] from holding himself out as President-elect;

(f) An order of mandatory injunction directing the [EC] to proceed to conduct a second election with Petitioner and [Nana Akufo-Addo] as the candidates as required under Articles 63(4) and (5) of the 1992 Constitution.

Several mistakes have been spotted that has got many talking after screenshots of the petition was released by various individuals on social media.

In one the numerous screenshots making waves on the internet, the NDC declared both Nana Addo Dankwa Akufo-Addo and the Electoral Commission as the first (1st) respondents.

This is a misleading information to the general public and has caught the attention of many netizens since it’s released in the internet.

Also, in relief (F), that is where the fatal error occurred. The petitioner, John Dramani Mahama is requesting the supreme court, to direct the 1st respondent, to organise another election between the petitioner and the 1st respondent.

Since the NDC is referring the Electoral Commission and Nana Addo Dankwa Akufo-Addo as their 1st respondents it has really caused massive confusion among netizens.

Is a big error because to organize another election between the petitioner and the 2nd respondent not 1st respondent.

Thedistin.com spotted on one comment from a netizen on Facebook who was also confused about the error of referring two parties as the 1st respondents. The FB netizen wrote “NDC paaaa be joke how could you petition an error to the highest court… Mahama wants a round-of between NDC and EC 1st respondent”.

This may probably be a typing error which had escaped the eagle eyes of the NDC legal team.

But since the NDC are very eager getting what they feel have been taken from them, they might have gone through their petition to the Supreme Court thoroughly but humans are bound to make mistakes.

However, if they do not make efforts to go back and correct them, It could prove to be the last straw that broke the camels back.
